EXPLANATORY NOTE

 

This bill seeks to create a new appointive barangay position to be known as the Barangay Population Worker , amending for the purpose, the Local Government Code of 1991, as amended.

 

The State recognizes that there exists an interdependence between population, development and environment. The Philippines, in fact, is now rated as being one of the highest in population density among developing countries. A large and rapidly growing population place enormous pressures on cities, on land and on the forests. Without enough opportunities for human development, a large population stands as an impediment to a more productive economy.

 

The creation of the office of Barangay Population Worker will strengthen the government's capacity to seek new information on population concerns. The Barangay Population Worker shall be tasked to conduct studies on reproductive technologies currently in use, and collect, analyze and disseminate basic data on population principles and development. With this, a factual basis for understanding the interrelationship of population, socio-economic and environmental variables is established.

 

The government must be productive in educating society about family planning and in making the people aware of the problems that beset most of the country’s large families.

 

A population worker can thus provide such service. Hence, a new section creating an appointive barangay position to be known as Barangay Population Worker should be inserted in the Local Government Code of 1991, as amended.

 

In view of the foregoing, approval of this bill is earnestly recommended.

AN ACT

CREATING THE POSITION OF BARANGAY POPULATION WORKER, GRANTING BENEFITS THERETO, AMENDING FOR THE PURPOSE THE "LOCAL GOVERNMENT CODE OF 1991," AS AMENDED, AND APPROPRIATING FUNDS THEREFOR.

 

Be it enacted by the Senate and House ~r Representatives the Philippines in Congress assembled:

 

SECTION 1. Section 387 of Republic Act No.7160, otherwise known as the "Local Government Code of 1991," as amended, shall be further amended, to read as follow:

"SEC. 387. Chief Officials and Offices.- (a) There shall be in each barangay a punong barangay, seven (7) sangguniang barangay members, the sangguniang kabataan chairman, a barangay secretary, [and] a barangay treasurer AND A BARANGAY POPULATION WORKER."

 

SEC. 2. Section 389, paragraph (5) of the same Act is hereby amended to read as follow:

"SEC. 389. Chief Executive: Powers, Duties, and Functions.-

 

(5) Upon approval by a majority of all the members of the sangguniang barangay, appoint or replace the barangay treasurer, the barangay secretary, THE BARANGAY POPULATION WORKER, and other appointive barangay officials;"

 

SEC. 3. A new provision shall be inserted between Sections 395 and 396 of the same Act to be denominated as Sec. 395-A and which shall read as follows:

 

"SEC. 395-A. BARANGAY POPULATION WORKER: APPOINTMENT, QUALIFICA TIONS, POWERS AND DUTIES. -(A) THE BARANGAY POPULA TION WORKER SHALL BE APPOINTED BY THE PUNONG BARANGAY WITH THE CONCURRENCE OF THE MAJORITY OF ALL THE SANGGUNIANG BARANGAY MEMBERS. THE APPOINTMENT OF THE BARANGAY POPULATION WORKER SHALL NOT BE SUBJECT TO ATTESTATION BY THE CIVIL SERVICE COMMISSION.

 

(B) THE BARANGAY POPULATION WORKER SHALL BE OF LEGAL AGE, A QUALIFIED VOTER, AND AN ACTUAL RESIDENT OF THE BARANGAY CONCERNED.

 

(C) NO PERSON SHALL BE APPOINTED BARANGAY POPULATION WORKER IF HE IS A SANGGUNIANG BARANGAY MEMBER, .A GOVERNMENT EMPLOYEE, OR A RELATIVE OF THE PUNONG BARANGAY WITHIN THE FOURTH CIVIL DEGREE OF CONSANGUINITY OR AFFINITY.

 

(D) THE BARANGAY POPULATION WORKER SHALL:

 

(1) FORMULATE MEASURES DESIGNED TO ENSURE THE DELIVERY OF BASIC SERVICES AND PROVISION OF ADEQUATE FACILITIES RELATIVE TO THE INTEGRATION OF POPULATION DEVELOPMENT PRINCIPLES AND IN PROVIDING ACCESS TO SAID SERVICES AND FACILITIES;

 

(2) DEVELOP PLANS AND STRATEGIES AND IMPLEMENT THE SAME, PARTICULARLY THOSE WHICH HAVE TO DO WITH THE INTEGRATION OF POPULATION DEVELOPMENT PRINCIPLES AND METHODS IN PROGRAMS AND PROJECTS;

 

(3) IMPLEMENT THE CONSTITUTIONAL PROVISIONS RELA TIVE TO POPULA TION DEVELOPMENT AND THE PROMOTION OF RESPONSIBLE PARENTHOOD TO POLICY MAKERS, IMPLEMENTORS, BENEFICIARIES AND THE COMMUNITY AS A WHOLE AND TO CONDUCT TRAININGS FOR THEM;

 

(4) ORGANIZE THE POPULATION COMMITTEE FOR THE BARANGAY TASKED TO FORMULATE MEASURES NECESSARY TO CARRY OUT THE PURPOSES AND OBJECTIVES OF THE BARANGAY

POPULATION OFFICES.

 

(5) ESTABLISH AND MAINTAIN AN UPDATED DATA BANK FOR PROGRAM OPERATION, DEVELOPMENT PLANNING AND AN EDUCATIONAL PROGRAM TO ENSURE THE PEOPLE'S PARTICIPATION IN, AND UNDERSTANDING OF POPULATION DEVELOPMENT;

 

(6) DEVELOP AND MANAGE SPECIAL PROJECTS ON POPULATION CONCERNS AS THE NEEDS ARISES; AND

 

(7) EXERCISE SUCH OTHER POWERS AND PERFORM SUCH OTHER DUTIES AND FUNCTIONS AS MAY BE PRESCRIBED BY LAW OR ORDINANCE."

 

SEC.4. Section 393, paragraphs (a) and (b) of the same Act is hereby further amended to read as follows:

 

"SEC. 393. Benefits of Barangay Officials. -(a) Barangay officials, including barangay tanods and members of the lupong tagapamayapa, shall receive honoraria, allowances, and such other emoluments as may be authorized by law or barangay, municipal or city ordinance in accordance with the provisions of this code, but in no case shall it be less than One thousand pesos (P 1,000.00) per month for the punong barangay and Six hundred pesos (P600.00) per month for the sangguniang barangay members, barangay treasurer, [and] barangay secretary AND BARANGAY POPULATION WORKER: Provided, however, That the annual appropriations for personal services shall be subject to the budgetary limitations prescribed under Title Five, Book II of this Code.

(b) The punong barangay, the sangguniang barangay members, the barangay treasurer, [and] the barangay secretary AND THE BARANGAY POPULATION WORKER shall also:

(1) Be entitled to Christmas bonus of at least One thousand pesos (P 1,000.00) each, the funds for which shall be taken from the general fund of the barangay or from such other funds appropriated by the National Government for the purpose;

SEC. 5. The Department of the Interior and Local Government shall issue the necessary rules and regulations for the proper implementation of this Act.

 

SEC. 6. The amount necessary for the initial implementation of this Act shall be charged to the appropriations of the Department of the Interior and Local Government under the current General Appropriations Act. Thereafter, such sum as may be needed for the continued implementation of this Act shall be included in the annual budget of the city or municipal government to which the barangay belongs.

 

SEC. 7. This Act shall take effect upon its approval.
